ORDER : This writ petition has been filed, calling for the records pertaining to the impugned order passed by the 4th respondent in her proceedings Nil dated Nil and quash the same as illegal and conseqauently, direct the 3rd respondent to register FIR on petitioner's complaint dated 12.11.2015 within stipulated time. 2. It is seen that Jeyalakshmi / petitioner herein lodged a complaint on 12.11.2015 before the respondent police and since no action was taken thereon, she filed a petition in Crl.O.P.(MD)No.22590 of 2015, in whichi this Court was pleased to direct the 3rd respondent to take action in accordance with law laid down by the Apex Court in Lalitha Kumari vs. Govt. of U.P & others [2013 (4) Crimes 243 (SC). The said order was passed on 30.11.2015. 3. Thereafter, the respondent police conducted an enquiry on the complaint given by Jeyalakshmi and closed the same by an undated order impugned herein and a copy of the closure report has also been served on Jeyalakshmi, challenging which, the present petition has been filed. 4. In Lalitha Kumari's case, the Supreme Court has stated that preliminary enquiry should be conducted and the complainant should be informed about the outcome of it. In this case, Police have informed the final outcome by serving on the complainant a copy of the closure report. In the considered opinion of this Court, the Writ of Certiorarified Mandamus will not lie and the remedy available to the petitioner is to approach the Magistrate by way of a private complaint, if so advised. This Court cannot step into the shoes of the Investigating Officer and decide about the validity of the closure report. 5. With the above observation, this Writ Petition is closed. No costs.
