JUDGMENT Ramesh Sinha, J. Heard Sri D.D.Mishra, Advocate, holding brief of V.S.Shukla, learned counsel for the applicants, Sri A.K.Yadav, learned A.G.A. for the State and perused the record. 2. This 482 Cr.P.C. application has been filed with a prayer to quash the charge sheet dated 28.12.2012 submitted in case crime no.1205 of 2012 (State Vs. Shanti Devi), under Sections 406, 504 I.P.C., police station-Izzatnagar, District Bareilly. 3. It has been contended by the learned counsel for the applicant that there was an agreement to sale between the applicant and opp. party no.2 for selling the vehicle in question amounting to Rs.2.50 lacs and the applicants were given Rs.80,000/-. He further submits that thereafter some differences arose between the parties, hence the said agreement to sale could not be executed. He argued that the applicants are ready to refund Rs.80,000/- which has been received by him from opp. party no.2. 4. Considered the submissions advanced by learned counsel for the parties. 5. The applicants are directed to move an application before the Court below raising all their grievance and the Court below shall decide the same in accordance with law after hearing both the parties within a further period of four weeks. 6. For a period of eight weeks from today, no coercive shall be taken against the applicants in the aforesaid case. 7. With the aforesaid direction, the present 482 Cr.P.C. application stands disposed of.
