JUDGMENT : 1. The petitioner is aggrieved by transfer order dated 02.08.2016 whereby she alongwith three others have been directed to report to their original place of positing i.e., in the case of petitioner to AD Koti as she is working in District Hospital Doda. Her prayer is that there is a threat perception to her and her family from ANEs (Anti National Elements). Petitioner relies upon the communications of Sr. Superintendent of Police, Doda dated 15.07.1999 and 07.08.2008, wherein it has been mentioned that the petitioner has complete threat from ANEs. Based on the such report, she was posted in District Hospital Doda vide order dated 23.10.2010 and till date she is continuing there. Earlier she filed a writ petition bearing SWP No. 828/2011, which came to be disposed of by this Court vide order dated 28.02.2012 with the following directions: “This petition is, accordingly, disposed of and the respondent No. 2 is directed to take a view in the matter and while doing so, he is at liberty to seek report/s from the appropriate police authorities. Till a view is taken by the respondent No. 2 the impugned relieving order No. 72-82 dated 09.04.2011 (annexure-C to the writ petition), in so far as it relates to the petitioner, shall not be acted upon and she shall be allowed to continue at District Hospital Doda.” 2. Learned counsel for the petitioner states that similar threat is likely at AD Koti, therefore, she has filed the instant writ petition. The petitioner at the first instance should have given a representation to the Medical Superintendent District Hospital, Doda seeking her retention on the basis of security threat and in light of the earlier order, the authority would have been in a position to consider the claim of the petitioner. 3. This Court while admitting the writ petition on 05.09.2016 has granted the following interim protection to the petitioner:- “Notice. On asking, Mr. P. S. Chandel, Dy.AG waives notice on behalf of respondents. Objections by the next date. List in the week commencing 17.10.2016. Meanwhile, as ad interim, subject to objections, impugned order dated 02.08.2016, whereby the petitioner has been posted at AD Koti shall stay till next date before the Bench only unless extended.’ 4.
On asking, Mr. P. S. Chandel, Dy.AG waives notice on behalf of respondents. Objections by the next date. List in the week commencing 17.10.2016. Meanwhile, as ad interim, subject to objections, impugned order dated 02.08.2016, whereby the petitioner has been posted at AD Koti shall stay till next date before the Bench only unless extended.’ 4. In this view of the matter, petitioner is given liberty to make a detailed representation, along with report of the police on which she relies upon before respondent No. 2 Director Health Services, Jammu so as to enable him to take a decision to post the petitioner in a appropriate pace to safeguard her rights and liberty. The petitioner is given four weeks time to submit the representation along with the police report, if any. On such representation being filed, respondent No.2 shall accord consideration and dispose of the same on its own merits expeditiously, preferably within a period of two weeks from the date of receipt of representation along with the copy of this order. 5. Writ petition is disposed of as above.
