JUDGMENT : Anil R. Dave, J. We have heard learned counsel for the parties. 2. Leave granted in both the special leave petitions. 3. These appeals by special leave are directed against the judgments and orders dated 7.11.2009 in Writ Petition No. 2894 of 2008 and Writ Petition No. 940 of 2008 where under the High Court disposed of the petitions. 4. In view of the judgment delivered in Talson real Estate (P) Limited v. State of Maharashtra and Others, reported in (2007) 13 SCC 186 , these appeals deserve to be allowed and they are, accordingly, disposed of as allowed. 5. However, so as to compensate the respondents, we direct that 50% more amount shall be awarded to the respondents and the said 50% amount shall be calculated on the basis of total amount which has been paid or which is payable to the respondents, in terms of the Award. The said amount shall be paid to the respondents within three months from today.
