JUDGMENT 1. Mr. M.C. Pant, Advocate with Mr. Ramji Srivastava, Advocate for the petitioner. 2. Mr. V.K. Kohli, Senior Advocate assisted by Mr. Kant Ram Sharma, Advocate for the respondent. 3. It is not in dispute that both the candidates have secured 3297 votes. Once, the candidates had secured equal number of votes, the Returning officer was required to comply with Regulation 4(l)(Kha) framed by State Election Commission, wherein, it has been provided that in an eventuality, where both the candidates get equal number of votes, then the Returning Officer shall decide the matter by draw of Iots. 4. The Returning Officer should have complied with Regulation 4(1](Kha) framed by State Election Commission. 5. In this matter, the Additional District Judge, Vikas Nagar, District Dehradun, has exceeded its jurisdiction by oriering for re-election instead of permitting the draw of lots, since, both the candidates secured equal number of votes i.e. 3297 votes. 6. This Court requests Mr. S.P.S. Panwar, President, High Court Bar Association, to hold the draw of lots on 06.10.2016 in his presence as well as in presence of both the candidates. 7. The parties are directed to pay Rs. 50,000/- each to Mr. S.P.S. Panwar, President, High Court Bar Association. It is permissible for the President to utilize the amount, so deposited, for the welfare of lawyers. 8. In view of this procedure, adopted by the Court, the impugned judgment dated 31.7.2015 passed by the Additional District Judge, Vikas Nagar Dehradun in Election Petition No.76/2013, is hereby set aside. 9. Parties shall abide by the outcome of draw of lots without raising any objections. 10. Petition stands disposed of in the above terms.
