JUDGMENT : Sudhanshu Dhulia, J. All the petitioners before this Court are working on daily rated basis on the Class – III posts in Kumaon Mandal Vikash Nigam (in short “KMVN”), which is a Government Company and admittedly the Rules, which are applicable for the regularization in the Government service, are also applicable in the KMVN as well. The petitioners have common prayer that although they are not being regularized on Class – III posts but they are working on that posts for the last more than ten years. In order to get the facts straight, the General Manager of KMVN was directed to bring the number of vacancies existing in the KMVN before this Court, on which the petitioners may be regularized. Today Mr. Trilok Singh Martolia - General Manager, KMVN is present in person before this Court and also filed an affidavit wherein it has been stated that as and when vacancies arise on the Class-III posts where 50 % posts are to be filled by way of promotion in the existing Class – III employees and on the remaining 50% posts, petitioners will be adjusted. Mr. Trilok Singh Martoliya has also stated that by December 2016 ten vacancies are likely to be vacant, which will be filled by the present petitioners. The remaining vacancies will be filled as and when it comes. In view of the above assurance that the petitioners will be regularized and in all likelihood, it will be done by the next year, there is no purpose to keep the matters pending before this Court. Accordingly, all the writ petitions stand disposed. No order as to costs.
