JUDGMENT Hon’ble Sudhanshu Dhulia, J. Heard Mr. M.S. Pal, Senior Advocate assisted by Mr. Lalit Sharma, Advocate for the applicant, Ms. Mamta Joshi, Brief Holder for the State of Uttarakhand and Mr. Manav Sharma, Advocate for the complainant. 2. The applicant is in jail having been implicated in FIR No. 177 of 2015, which has been registered under Sections 363/366/120B of IPC and under Section 16/17 of the Protection of Children from Sexual Offences Act, at Police Station- Bazpur, District-Udham Singh Nagar. 3. The first bail application of the applicant was dismissed as withdrawn by this Court vide order dated 14.03.2016. 4. This is the second bail application filed by the applicant on the ground that co-accused has been granted bail by this Court. As per the First Information Report, the role of the applicant is that he instigated his brother to elope with a girl, namely, Ms. Navneet Kaur, who is 13 years of age. The father of the girl lodged the First Information Report in which there are allegations of trafficking as well. The applicant is in jail since 04.08.2015. 5. Considering the overall evidence, which is presently available before this Court, prima facie, the applicant has been able to make out a case for bail. The bail application is allowed accordingly. 6. Let the applicant be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the Magistrate concerned. 7. It is made clear that any observations made by this Court are only for the purposes of grant of bail. It shall not be taken into consideration at all in any other proceedings.
