P. O. A. Murugesan v. Superintendent of Police

2016-02-24

P.N.PRAKASH

body2016
ORDER : This writ petition has been filed, seeking a direction to the 1st and 2nd respondents to take departmental action against the 3rd respondent and to file the action taken report, considering the petitioner's complaint dated 26.02.2015 and the subsequent representation dated 22.12.2015. 2. On reading of the complaint, it is seen that this petitioner has lodged complaints dated 26.02.2015 and 22.12.2015 to the official respondents and now, he has come up with this petition, seeking for a writ of mandamus, directing the 1st and 2nd respondents to take departmental action against the 3rd respondent. 3. In the considered opinion of this Court, such a mandamus cannot be issued, since there are rules, governing the powers of superior officers to take departmental action for which, mandamus cannot be issued, as prayed for by the petitioner. 4. Hence, this Writ Petition is devoid of merits and the same stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
