JUDGMENT The relief which is sought in these proceedings which are instituted in the public interest is in respect of a gate which is stated to have been opened by the fifth respondent, which is a school, by the side of a public park situated in Greater Noida. According to the petitioner, the City Magistrate, Greater Noida has issued a direction on 9 May 2013 to the fifth respondent to close the gate and on 12 March 2013, in a disclosure made by the Greater Noida Industrial Development Authority, under the Right to Information Act 2005, it has been stated that no such gate has been permitted or sanctioned by the Development Authority. 2. At this stage, we are of the view that the ends of justice would met by directing the fourth respondent to scrutinize the grievance and if it is found to be genuine, upon due verification, to determine what action is necessary to secure compliance of law. This exercise shall be carried out by the fourth respondent expeditiously. We clarify that at this stage, we are not expressing any finding on the merits of the issue raised since it is primarily for the Development Authority to apply its mind and take action in accordance with law if a breach is found. 3. The petition is, accordingly, disposed of. There shall be no order as to costs.
