JUDGMENT : 1. The petitioner in this writ petition as alleged that he has made an application for grant of mining lease in respect of 6 acres of land pertaining to Plot No. 769 (P) under Mouza Nandabari, P.S. Debra, District Paschim Meddinipur. According to the petitioner the said application was submitted on 20th July, 2016 with all the requisite documents in support of mining lease. 2. Learned Advocate appearing for the private respondent submits that he is the present lessee in respect of the land for which the petitioner has made an application for mining lease. The private respondent apprehend that in the event the petitioner’s application for grant of mining lease is allowed then the private respondent’s interest in the land will be severally prejudiced. 3. In such circumstances, the writ petition is disposed of by directing the District Magistrate, Paschim Medinipur, respondent no.2, to take a reasoned decision on the application filed by the petitioner on 20th July, 2016 being Annexure P-8 to this writ petition within a period of eight weeks after giving an opportunity of hearing both to the petitioners and the private respondent no.7 as well. The parties will be permitted to produce all necessary documents in support of their respective claim before the District Magistrate. 4. With the aforesaid direction, the writ petition is disposed of.
