JUDGMENT The petitioner was appointed as Medical Officer on Ad-hoc basis on 17.3.1989. she was regularized on 24.7.2009 and as such she is working under the Karmchari Rajya Beem Yojna, Labour Medical Services, State of U.P. 2. It has been submitted that petitioner has completed 26 years of successful service. In the year 2006 the respondent No.1 has issued a seniority list. The petitioner's claim is with regard to reckoning of seniority on the basis of length of service, in view of the settled law laid down by the Apex Court in the case of Dr. Chandra Prakash & Others Versus State of U.P. reported in 2002 (10) SCC 710 . It has further been submitted that seniority of one of her junior Dr.Rekha Rani has been fixed as per decision of the Hon'ble Supreme Court, but the petitioner's matter has not been considered so far. Her representation is pending with the respondents. 3. In view of the aforesaid submission, we hereby issue direction to the State Government to reconsider the petitioner's seniority and take a decision in the light of the decision of Dr.Chandra Prakash and others (Supra) within two months from the date of communication of this order. In the aforesaid terms the writ petition stands disposed of finally.
