ORDER : This petition has been filed to quash the proceedings in M.C.No.(107) 04/2016 dated 08.01.2016 issued by the Sub Divisional Magistrate-cum-Sub Collector, Cheranmahadevi, Tirunelveli District. 2. Heard the learned counsel for the petitioners and learned Government Advocate (Crl.Side) appearing for the State. 3. It is seen that this petition has been filed, challenging the show cause notice dated 08.01.2016, asking the petitioners to show cause as to why a bond for Rs.2,500/-should not be collected from them for maintaining peace. 4. Since this is only a show cause notice, this Court is not inclined to quash the entire proceedings of the 1st respondent. However, liberty is granted to the petitioners to appear before the Executive Magistrate with an Advocate of their choice and to submit their explanation as to why they need not furnish bonds. The Executive Magistrate is directed to examine the issue independently and pass orders on merits and in accordance with law. If any final order is passed, it is open to the petitioners to challenge the same in accordance with law. With the above observation, this Criminal Original Petition is closed. Consequently, connected miscellaneous petition is closed.
