ORDER 1. Heard on admission. 2. This revision petition filed under section 77(14) of the M.P. Cooperative Societies Act, 1960, hereinafter to be referred as, “the Act” is directed again order dated 17.11.1999 passed by Joint Registrar Cooperative Societies, Sagar in Case No.77-9/1999 and order dated 31.3.2012 passed by Deputy Registrar Cooperative Societies, Tikamgarh in Case No.64-243/2011. 3. The necessary facts in nutshell are that agricultural land bearing survey No.433 and 433A admeasuring 1.126 hectare was mortgaged by Panna) father of present petitioners No.1 to 6 and husband of petitioner No.7) in connection with the loan transaction of Rs.16,500/- borrowed by him from District Cooperative Land Development Bank, Baldevgarh (N.A.2) for construction of well and installation of tubewell. The loan instalment were not paid as per agreement, therefore, due to default in repayment of loan the aforesaid land was attached and sold in public auction by N.A.2. The sale certificate was issued on 25.8.1995. 4. The aforesaid sale was challenged by Panna before Joint Registrar Cooperative Societies, Sagar in Case No.77-9/1999. The Joint Registrar Cooperative Societies, Sagar vide order dated 17.11.1999 after considering relevant facts and the material adduced before him came to the conclusion that auction and sale proceedings have been carried out in accordance with the relevant rules and that there is no infirmity in the proceedings. The sale certificate has been issued and possession has been delivered to the purchaser. Hence, no interference is called for in respect of auction sale proceedings. 5. The aforesaid order of Joint Registrar could have been challenged in second appeal, however, that remedy was not restored to. 6. Subsequently, after the death of Panna, present petitioners, by way of fresh petition under section 64 of “the Act” challenged the auction sale proceedings before Deputy Registrar Cooperative Societies, Tikamgarh, who vide order dated 31.3.2012, dismissed the petition as not maintainable, inter alia, observing that the auction sale proceedings had already been challenged before Joint Registrar and the controversy has already been settled by Joint Registrar, Sagar vide order dated 17.11.1999, which has attained finality. 7. It may be stated that the remedy of filing second appeal under section 78(2) of the Act was available against the order dated 17.11.1999 passed by Joint Registrar, however, the same was not availed. Therefore, that order cannot be made the subject matter of challenge in this revision. 8.

As regard order dated 31.3.2013 passed by Deputy Registrar Cooperative Societies, Tikamgarh, the same could have been challenged by way of first appeal under section 78(1), before Registrar or Joint Registrar. However, petitioner did not opt for that remedy, therefore, that order also cannot be examined in revision. 9. In view of the aforesaid, this revision, being not maintainable, is dismissed at motion stage itself. 10. No order as to the costs.
