ORDER : 1. Exemption from filing certified copy of the impugned judgment is granted. 2. Permission to place additional facts and documents on record is permitted. 3. We have heard Shri P. Chidambram, learned Senior Counsel appearing for the petitioners. 4. By the present Special Leave Petitions the petitioners seek to challenge the order of the learned single judge of the High Court of Calcutta. Appeal(s) against the order of the learned single judge has already been filed by the petitioners before the High Court of Calcutta. The petitioners herein apprehend that the said appeal(s) will not be heard before what the petitioners have perceived to be a cut off date i.e. 8th July, 2016. Hence the present approach has been made to this Court under Article 136 of the Constitution of India. In the above facts, we do not consider it appropriate to go into the merits of the case. However, at the same time it has to be ensured that the appeal(s) filed before the High Court is/are not rendered infructuous by passage of time. We, therefore, consider that the following order would meet the ends of justice. 5. The Division Bench of the High Court before whom a mention may be made on behalf of the Special Leave Petitioners will, perhaps, agree with this Court that the matter requires an out of turn hearing. In the course of the hearing, the High Court may consider the entitlement of the petitioners to an order of injunction which consideration will not necessarily be confined to what is on record as on date but also in respect of the steps in execution of such resolution that may be adopted in the Annual General Meeting of the Company which is scheduled on 8th July, 2016 insofar as the question of acquisition of interests in Reliance Cement Company Private Ltd. is concerned. 6. Learned Senior Counsel for the petitioner has also raised certain issues before this Court which concern the subject matter of the proceedings before the High Court particularly with regard to the composition of the APL Committee and for expeditious hearing of the probate proceedings.
6. Learned Senior Counsel for the petitioner has also raised certain issues before this Court which concern the subject matter of the proceedings before the High Court particularly with regard to the composition of the APL Committee and for expeditious hearing of the probate proceedings. The Division Bench of the High Court before whom the mention would be made for hearing of the matter in terms of the present order and the Bench which will hear the matter may consider the aforesaid questions/grievances raised before us and pass appropriate orders so as to ensure that the necessary mechanism (APL Committee) is in force and the probate proceedings are heard and concluded at an early date. 7. The Special Leave Petitions are disposed of in the above terms.
