JUDGMENT : Mansoor Ahmad Mir, CJ. Respondents have filed the reply. 2. It appears that the respondents have not followed Clause 13.4 of the relevant guidelines contained in Annexure P1. It is apt to reproduce clause 13.4 of the said guidelines herein. ?13.4.State Government shall set up a three member Appellate Authority, consisting of an academician, a retired civil servant and a civil society representative, to consider representation by any party aggrieved by the findings of the Ombudsman. Such a representation shall be disposed of within a period of two months by the appellate authority. Office of the appellate authority shall be located in the office of the nodal department of the State Government implementing MGNREGA. Expenses of such an appellate authority shall be borne by States from the 6% administrative expenditure permitted under section 22 (1) © of the MGNREGA.? 3. In the given circumstances, we deem it proper to direct the respondents/State to constitute a three member Appellate Authority in terms of the mandate of clause 13.4, referred to supra and report compliance before the Registrar (Judicial), within eight weeks from today. Ordered accordingly. Consequently, all the notifications, which are not in tune with clause 13.4 of the relevant guidelines supra, are quashed. 4. Having said so, the petition is disposed of alongwith pending application, if any.
