Mr. R.S. Mishra, learned counsel for the applicant. Mr. Kumud Konwar, learned Additional Public Prosecutor, Assam for the respondent. This is an application under Section 439 of the Code of Criminal Procedure for grant of bail on behalf of the applicant-Sri Sailen Medhi. The applicant has been arrested on 6.9.2016 for offences under Sections 420 and 406/34 of the Indian Penal Code registered at Police Station Tarabari vide Case No. 257 of 2016. According to the prosecution case, the applicant accepted money from the informant and other persons on the pretext of giving appointment to them as Mother Teachers. On due consideration of the fact that applicant is in jail since 6.9.2016, I deem it proper to grant bail to him. It is, accordingly, directed that he be released on bail in connection with the aforesaid case on his furnishing a bail bond of Rs.30,000/- with one surety of the like amount to the satisfaction of the Chief Judicial Magistrate, Barpeta. The bail application is allowed.
