Mr. P.K. Munir, learned counsel for the applicant. Mr. Kumud Konwar, learned Additional Public Prosecutor, Assam for the respondent. This is an application under Section 439 of the Code of Criminal Procedure for grant of bail on behalf of the applicant – Md. Amar Ali @ Omar. The applicant has been arrested on 24.08.2016 for an offence under Section 20(B) of the Narcotics Drugs and Psychotropic Substances (NDPS) Act, 1985 registered at Rangapara Government Railway Police Station (GRPS) vide Case No. 12/2016. According to the prosecution case, the applicant was travelling in a train with a hand bag in which he had kept 1800 grams of ganja. The bag was lying unattended in the compartment and the police suspected that it belonged to the applicant. It is argued on behalf of the applicant that he is innocent and has been falsely implicated. On due consideration of the facts and circumstances of the case, I deem it proper to grant bail to the applicant. It is, accordingly, directed that he be released on bail in connection with the aforesaid case on his furnishing a bail bond of Rs.30,000/- with one surety of the like amount to the satisfaction of the Special Judge, Sonitpur, Tezpur. The bail application is allowed.
