Mr. Talat Hamid Hazarika, learned counsel and Mr. A. Rashid, learned counsel for the applicant. Mr. Kumud Konwar, learned Additional Public Prosecutor, Assam for the respondent. This is an application under Section 439 of the Code of Criminal Procedure for grant of bail on behalf of the applicant- Rajib Hussain. The applicant has been arrested on 25.09.2016 for an offence under Section 379 of the Indian Penal Code registered at Police Station Basistha vide Case No. 975/2016. According to the prosecution case, the applicant along with co-accused persons has committed theft of about 76 tyres. It is argued on behalf of the applicant that he is innocent and has been falsely implicated. On due consideration of the fact that the applicant is in jail since 25.09.2016 and the offence is triable by Magistrate, I deem it proper to grant bail to him. It is, accordingly, directed that he be released on bail in connection with the aforesaid case on his furnishing a bail bond of Rs.25,000/- with one surety of the like amount to the satisfaction of the Chief Judicial Magistrate, Kamrup (Metro) at Guwahati. The bail application is allowed.
