Mr. Raj Sekhar, learned counsel for the applicant. Mr. N.K. Kalita, learned Additional Public Prosecutor, Assam for the respondent. This is an application under Section 439 of the Code of Criminal Procedure for grant of bail on behalf of the applicant – Bedanta Prasad Borah. The applicant has been arrested on 8.9.2016 for offences under Sections 120(B), 468, 420, 406 and 511 of the Indian Penal Code registered at Police Station Dispur vide Case No. 2147/2016. According to the prosecution case, the applicant along with co-accused persons presented a cheque in the Bank of India, Odalbakra Branch, Guwahati for encashment of Rs.41,51,00,111/-, which on verification, was found to be fake. It is argued on behalf of the applicant that he is innocent and has been falsely implicated. On due consideration of the facts and circumstances of the case and also the fact that the applicant is in jail since 8.9.2016 and the investigation is almost complete, I deem it proper to grant bail to him. It is, accordingly, directed that he be released on bail in connection with the aforesaid case on his furnishing a bail bond of Rs.25,000/- with one surety of the like amount to the satisfaction of the Chief Judicial Magistrate, Kamrup (Metro) at Guwahati. The bail application is allowed.
