Ms. Shivangi Gangwar, Advocate, present for the respondent no.2. 4. Mr. Rajesh Joshi, Advocate present for the respondent no.3. 5. Petitioner has appeared in an examination known as “Uttarakhand Teachers Eligibility Test-1”. A candidate has to qualify this examination to become a teacher in primary school. The petitioner appeared in Uttarakhand Teachers Eligibility Test-1 on 29.04.2015, the result of other has been declared, but respondent authority has not declared the result of the petitioner for the reason that the petitioner has less than 45% marks in graduation. 6. This controversy has already been set to rest by decision of this Court wherein the minimum cut off marks for graduation is 45% marks held to be arbitrary by this Court. 7. Learned counsel for the petitioner submits that this matter is squarely covered by the judgment dated 20.08.2011 passed in WPSS No.772 of 2011 (Baldev Singh and others Vs. State of Uttarakhand and others). 8. Learned counsel Ms. Shivangi Gangwar, appearing on behalf of Uttarakhand Board of School Education also admits that this matter is covered by the judgment dated 20.08.2011 passed by this Court in WPSS No.772 of 2011. 9. The writ petition stands disposed in terms of the judgment dated 20.08.2011 passed in WPSS No.772 of 2011 (Baldev Singh and others Vs. State of Uttarakhand and others). 10. Let the result of the UTET-1 in which the petitioner appeared be declared accordingly. 11. Let a certified copy of this order be issued to the learned counsel for the petitioner today itself, on the payment of usual charges.
