Heard on admission. This appeal is directed against the order dated 5.10.2016 passed by the learned Single Judge of this High Court whereby he has finally disposed of WP(C) No. 5365/2016 of Respondent Nos. 1 to 9 with a direction to the Deputy Commissioner, Barpeta (Respondent No. 2) to ensure that meeting is convened to discuss No-confidence Motion against the appellant. The appellant is President of No. 43 Dakhin Paka Gaon Panchayat under Paka Betbari Anchalik Panchayat in Barpeta District. Respondent Nos. 1 to 9 are members of the said Gaon Panchayat. They submitted a requisition for convening a special meeting for consideration of No-confidence Motion against the appellant. But since the meeting was not being convened by the competent authority on some pretext or the other, they filed WP(C) No. 5365/2016 seeking appropriate directions. And on being asked by the learned Single Judge to obtain instruction from the Deputy Commissioner why he did not act on the requisition, a statement was made by the learned Senior Government Advocate that due to heavy burden of administrative work, the meeting could not be convened. The learned Single Judge disapproved the reason given and has directed the Deputy Commissioner, Barpeta to convene a meeting in accordance with law. It is informed at the Bar that the date for such meeting is scheduled for tomorrow i.e. 20.10.2016. After hearing the counsel for the appellant, we find ourselves in complete agreement with the view taken by the learned Single Judge. The appeal has no merit and is accordingly dismissed summarily.
