Mr. N.S. Laskar, learned counsel and Mr. A.H.M.R. Choudhury, learned counsel for the applicant. Mr. M. Phukan, learned Additional Public Prosecutor, Assam for the respondent. This is an application under Section 439 of the Code of Criminal Procedure for grant of bail on behalf of the applicant – Samsul Ahmed Laskar. The applicant has been arrested on 16.09.2016 for offences under Section 120(B), 409, 468, 419 and 420 of the Indian Penal Code registered at Police Station Hailakandi vide Case No. 412/2016 corresponding to G.R. Case No. 1459/2016. According to the prosecution case, a sum of Rs.13.52 lakh was fraudulently withdrawn under MGNREGA scheme. Admittedly, on the same facts and circumstances, co-accused Anjan Deb Nath has been directed to be released on bail by another learned Single Judge of this Court vide order dated 3.10.2016 passed in Bail Application No. 1062 of 2016 (Annexure-3). I, therefore, in order to maintain parity, direct that the applicant be also released on bail in connection with the aforesaid case on his furnishing a bail bond of Rs.10,000/- with one surety of the like amount to the satisfaction of the Chief Judicial Magistrate, Hailakandi. The bail application is allowed.
