JUDGMENT Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. The petitioner before us is seeking a writ of mandamus directing respondents to complete chakroad No.3109 situated in Village Binour, Tehsil Sadar, Kanpur Nagar according to Master plan of Mahatma Gandhi National Rural Employment Guarantee Act, 2015-16 after getting encroachment removed of the chakroad within one month. 3. It is submitted by learned counsel for the petitioner that seeking removal of encroachment over the chakroad by the private respondents, an application under Section 133 Cr.P.C. was moved on 31.1.2014 which was finally disposed of by the S.D.M., respondent no.3. Claiming that no action has been taken by the S.D.M,Sadar, District Kanpur Nagar, petitioner approached this Court under Section 482 Cr.P.C. The petition under Section 482 Cr.P.C. was disposed of by this Court by directing the S.D.M. to conclude the matter and take a decision. S.D.M. took cognizance and called for report from Lekhpal and Revenue Officer. It is reported that private respondents have encroached over the chakroad. It is stated that after considering the facts and circumstances of the case passed an order directing Tehsildar and S.H.O. Sachendi to remove the encroachment from the chakroad. The said encroachment has not been removed, so the petitioner moved an application before District Magistrate, Kanpur Nagar which is still pending. 4. In the facts and circumstances of the case, the District Magistrate, Kanpur Nagar is directed to consider the representation made by the petitioner before him and decide it in accordance with law expeditiously. 5. In view of aforesaid direction, the writ petition is disposed of.
