This is first application filed by the applicants/accused under section 438 of Criminal Procedure Code for grant of anticipatory bail, apprehending their arrest in connection with Crime No. 1468/16, registered at Police Station Umaria Pan, District Katni (MP), for the offence under sections 409 and 420/34 of the Indian Penal Code. 3. The allegations against the applicants are that they were managing the shops relating to distribution of goods under the Public Distribution System and they did not distribute the goods in some months to the public and misappropriate the goods. 4. It is contended on behalf of the applicants/accused that they are falsely implicated in the case. No proper inquiry has been made in the case and without giving any opportunity to submit the record, false case has been registered. For the purpose of investigation, their custody is not required. Further, they are ready to co-operate the investigating agency. Hence, prayer is made to enlarge them on anticipatory bail. 5. Learned Panel Lawyer has opposed the bail application. 6. Without commenting anything on the merits of the case, as custodial interrogation of the applicants is not required, this application is allowed and it is ordered that if the applicants-accused Ram Singh Marko and Rajesh Dahiya surrender before the Arresting Authority/Investigating officer in relation to the aforesaid crime number, within 15 days from today and if they are arrested by the Investigating officer, they shall be released on bail on their furnishing bail bond and surety bond each for a sum of Rs. 50,000/- ( Rs. Fifty Thousand only). If they failed to do so, the effect of this order shall be vacated automatically. 7. The applicants-accused are directed to join the investigation immediately and fully co-operate with the investigation. They shall further abide by the other conditions enumerated in sub-section (2) of section 438 of Criminal Procedure Code. Certified copy as per rules.
