JUDGMENT : Dhiraj Singh Thakur, J. Petitioner seeks grant of benefit of higher pay scale in terms of SRO 225, dated 04.07.1997 with effect from the date, the same was given to his junior Sansar Chand. 2. Briefly stated, the case of the petitioner is that one Sansar Chand, Junior Assistant was placed on a higher pay scale of Rs. 5000-8000, whereas the petitioner, who despite being senior to him was placed in the pay scale of Rs. 4000-6000. 3. It is urged that the date of appointment of Sansar Chand is 28.01.1967, whereas the date of appointment of the petitioner is. 18.01.1967 and that being senior to Sansar Chand, the petitioner was illegally denied the benefit of the higher pay scale. 4. SRO 225 was aimed to remove this anomaly and envisaged that a senior official shall be allowed the pay scale equivalent to the pay scale of his junior counterpart, with effect from the date latter was allowed provided both the junior and senior officials. 5. Objections have been filed. However, it is not denied that Sansar Chand was junior to the petitioner. 6. Admittedly, the petitioner being senior to the aforementioned official has a right to be placed in the same higher pay scale and with effect from the same date as Sansar Chand, in terms of SRO 225 aforementioned. 7. This petition is accordingly, allowed. The petitioner's case be considered in the pay scale of Rs. 5000-8000 (un-revised) with effect from the date the same was granted in favour of his junior Sansar Chand. The petitioner is held entitled to seek arrears and all consequential benefits and the interest @ 6% shall be paid on the amount so withheld. 8. Disposed of.
