ORDER : Sabina, J. Petitioner has filed this petition under section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No.178/2014 registered at Police Station Moti Doongari Jaipur City Jaipur, for offences under section 202, 203, 276, 420, 120-B, 468, 486 Indian Penal Code 1860 and Section 18/27, 18/28, 36 Drugs and Cosmetics Act 1940. 2. Learned counsel for the petitioner has submitted that present case relates to recovery of fake injections. The person from whom fake injections were recovered had stated that he had purchased the same from Yogendra Sharma and also gave the mobile phone number of Yogendra Sharma. Petitioner is neither Yogendra Sharma nor the phone number in question belongs to the petitioner. 3. Learned counsel for the petitioner has submitted that petitioner is ready to join investigation. 4. Learned State Counsel on instructions from the Sub Inspector, Rajendra Singh, Investigating Officer, has opposed the petition, but has failed to controvert the factual aspect of the submissions made by learned counsel for the petitioner. 5. Accordingly, without expressing any opinion on merits of the case, this petition is allowed. In the event of arrest, petitioner be admitted on bail subject to satisfaction of the Arresting Officer. Petitioner shall join investigation as and when required by the police and shall not leave the country without prior permission of the Court. Petitioner shall not tamper with the prosecution evidence.
