Mansoor Ahmad Mir, J. (Oral) Learned counsel for the petitioner stated that she is under instructions not to file rejoinder to the reply filed by respondent No.1. Her statement is taken on record. Right to file the rejoinder stands closed. Mr.Rajeshwar Thakur, Advocate, stated that he is under instructions to adopt the reply filed by respondent No.2 on behalf of respondents No.2(a) to 2(e). His statement is taken on record. Ordered accordingly. 2. By the medium of instant petition, the petitioner has called in question the order, dated 3rd January, 2015, passed by the District Judge, Shimla, (Appellate Authority), whereby the order, dated 4th November, 2009, made by the Commissioner, Municipal Corporation, Shimla came to be set aside on the edifice and foundation the mention of which has been made in paragraph 20 of the order passed by the District Judge/Appellate Authority. A perusal of the order passed by the Appellate Authority reveals that the order impugned before the said Authority was set aside only on technical grounds. 3. At this stage, the learned counsel for the parties stated that the case is pending before the Commissioner, Municipal Corporation, Shimla and is fixed for 25th March, 2017. In the given circumstances, the instant writ petition is not maintainable. Accordingly, we deem it proper to dispose of the writ petition with a direction to the Commissioner, Municipal Corporation, Shimla to take the said proceedings to the logical end within a period of three months from today after providing adequate opportunity of hearing to all the parties concerned. Ordered accordingly. It is made clear that any observation made by the Appellate Authority in its order, impugned before us, shall not cause prejudice to any of the parties and also shall not influence the mind of the Commissioner. Parties to cause appearance before the Commissioner, Municipal Corporation, Shimla on 25th March, 2017. Pending CMPs, if any, also stand disposed of.
