JUDGMENT : This appeal is before us to examine correctness of the judgment dated 10.06.2010 passed by learned Family Court, No.1, Jodhpur, dismissing an application preferred under Section 13 of the Hindu Marriage Act, 1955. 2. Learned Family Court while dismissing the application arrived at the conclusion that the allegations of cruelty and desertion on the part of the respondent were not well founded. 3. During the course of the adjudication of appeal, this Court decided to have conciliation between the parties and, therefore, under an order dated 21.02.2017 the parties were directed to remain personally present before the Court on next date of hearing i.e. 07.03.2017. 4. In pursuance to the order aforesaid, the parties reported to the court on 07.03.2017 and 17.04.2017 and participated with all positivity in the process of conciliation. 5. On 17.04.2017 respondent Dr. Nilima Gehlot shown willingness to accept the lump-sum maintenance in a tune of Rs.30,00,000/- in one stock as offered by the appellant Shri Kamlesh Sankhla. At the request of the parties, the matter then was adjourned for 25.04.2017. 6. Today, the parties present before the Court with their counsels submit that they have already entered into an agreement and a copy whereof is also placed on record. Having considered the contents of the compromise arrived between the parties, we deem it appropriate to dispose of the instant appeal in the terms of the same. 8. The appellant handed over the original Demand Drafts details of which are given in the recorded compromise to us and we have handed over the same to the respondent present before us. 9. On payment of Demand Draft, the marriage between the parties that took place on 04.05.1998 at Jodhpur stands annulled. A decree-sheet be prepared as per the terms of compromise arrived between the parties and be granted. Accordingly, the appeal stands disposed of.
