JUDGMENT : 1. Heard learned counsel for the parties and perused the record. 2. The writ petitioner, herein respondent No. 1 has challenged primarily and inter alia the selection process as well as the appointment orders dated 01.08.2017 and 04.08.2017 whereby the appellants have been appointed as Junior Legal Assistants and Legal Assistants in the office of the Advocate General, J&K State. Learned writ court vide order dated 27.10.2017, while taking a prima facie view that there had been total deviation from the J&K Special Recruitment Rules, 2015 in the selection process and noticing that the selected candidates have joined, as interim measure directed that till objections are filed and considered, the pay of the appointed candidates, therein private respondents, shall not be drawn or disbursed. This order is impugned in these Letters Patent Appeals. 3. The appellants feel aggrieved to the extent the impugned order provides for stopping their salary. 4. It is noticed by us that the learned Writ Court has not opted to stay the selection and appointment of the writ-respondents (private). It being so, the order stopping their salary would not be in the fitness of the things, because once the appellants are allowed to render services, stopping salary would not be justified. 5. Viewed thus, we allow these appeals and set-aside the impugned direction issued by the learned Writ Court. 6. The record of the Writ Court be remitted back along-with a copy of this order where both the sides shall cause their appearance on the date to be fixed by the Registry in the week commencing 26.02.2018. In the meantime, it shall be open for the appellants and all the respondents to file objections to the main writ petition as well as the MP with advance copy to the writ-petitioner’s counsel. 7. Both the appeals are disposed of.
