Agatha Kullu v. State of Jharkhand

2017-07-13

APARESH KUMAR SINGH

body2017
JUDGMENT : 1. Permission to file 2nd supplementary show cause on behalf of the opposite party no. 3 in all the matters except Cont. (Civil) Case Nos. 320 of 2015, 321 of 2015, 718 of 15 and 754 of 2015 is allowed. In those 4 cases another State counsel is appearing and no such separate show cause is being filed as of now. 2. However, learned AAG, Mr. Jai Prakash submits that the same office order bearing Memo No. 1268 (26) Ranchi dated 06.07.2017 issued by the Director-in-Chief, Health Services, Jharkhand, Ranchi applies to the case of those petitioners also. It is submitted that Health Department by the instant office order granted the benefit of pay in the scale of Rs. 9300- 34,800/-, PB-II and Grade Pay-4600/- w.e.f. 20.07.2012 in terms of the Jharkhand Nursing Cadre Appointment, Promotion and Service Conditions Rules, 2012, which was the prayer in the writ petition. 3. Learned counsel for the State submits that on issuance of this office order, consequential benefits are to be extended by the RINPAS. 4. Learned counsel for the petitioner submits that only apprehension of the petitioners left is that this office order should not be meant to modify the benefits of ACP/MACP, which the petitioners have got subsequent to 20.07.2012. The instant office order should mean to indicate the basic scale and grade pay as on 20.07.2012. 5. Learned AAG on behalf of the State and the counsel for the RINPAS submit that there is no such confusion in the order. 6. It goes without saying that opposite party-official of the RINPAS would extend the consequential benefits now in terms of the office order dated 06.07.2017 and the order passed in the writ petition within a reasonable time preferably within a period of 12 weeks from the date of receipt of a copy of this order. 7. In view of the show cause filed and the submission of the learned counsel for the parties, all these Contempt Petitions stand disposed of as the order stands complied with. Proceedings are dropped. I. A. No. 5649 of 2017 stands closed.
