ORDER : 1. Leave granted. 2. We have heard the learned counsels for the parties. 3. On due consideration we are of the view that the condition imposed by the High Court with regard to deposit for grant of bail needs to be modified. This is particularly so having regard to the fact that the co-accused i.e. officials of the Excise Department have been granted bail without any condition. Accordingly, we modify the order of the High Court dated 19th April, 2016 granting bail to the accused appellant by setting aside the pre-condition of deposit. The accused appellant will now be entitled to bail without making any deposit in terms of the order of the High Court dated 19th April, 2016. 4. The appeals are allowed and the orders of the High Court are set aside to the extent indicated above. ORDER : Leave granted. The appeals are allowed in terms of the signed order.
