ORDER : SONIA GOKANI, J. This application is preferred for extension of Temporary Bail, the applicant is seeking extension of Temporary Bail for the period of thirty days in connection with C.R No. I-4 of 2015 registered with Hansot Police Station for the offences punishable under Sections 143, 147, 148, 149, 201 B, 302, 325, 307, 427, 435 of the Indian Penal Code, Section 135 of the Gujarat Police Act and Section 25(10) A of the Arms Act. It is his say that from 23rd June, 2017 to 2nd July, 2017, he released on Temporary Bail, he would schedule to surrender today. Now, present application is filed for extension of Temporary Bail for a period of thirty days on the ground of death of his maternal grandfather. 2. This Court has heard the learned advocate Ms. Mousami K. Vala. She has urged that the 10th day and 20th day ceremony of the maternal grandfather would necessitate his presence. Therefore, the Court may allow this application for Temporary Bail. 3. RULE. Ms. Shruti Pathak, learned Additional Public Prosecutor waiving the service of Rule for and on behalf of the respondent-State of Gujarat and has urged that he has been already granted nine times Temporary Bail from January, 2016 till today. She also has urged that as he was already on Temporary Bail when his maternal grandfather passed away on 27th June, 2017, there is no reason for the Court to now extend his date. 4. Considering the fact that the important ceremony for any person following Islam would be the 40th day which is Chalisva ceremony and not as being insisted by the applicant herein coupled with the fact that at the time of the sad demise of his maternal grandfather he was already on Temporary Bail on account of the ill health of his mother. Therefore, no reasons made out for allowing this application since he is required to surrender by today evening and had made this application is permitted to do so by tomorrow 12:00 O'clock. 5. Rule made absolute to the aforesaid extent. 6. Direct Service is permitted.
