AMOL RATTAN SINGH

body2017
JUDGMENT : Amol Rattan Singh, J. 1. Learned counsel for the petitioner submits that the material witnesses have already been examined but there are still a large number of witnesses remaining to be examined and as such, despite the fact that the petitioner is in custody since 16.03.2016, the trial is nowhere near conclusion as yet. 2. Learned State counsel, upon instructions, submits that out of 13 witnesses, only 2 have been examined so far, who are admitted to be the only really material witnesses. 3. In view of the above, without commenting on the merits of the case, the present petition is allowed. The petitioner would be enlarged on bail to the satisfaction of the trial Court, subject to his continuing to appear before the trial Court as and when summoned, and complying with all other conditions as would be laid down by that Court.
