ORDER 1. This is a repeat application under section 439 of the CrPC for grant of bail to applicant. 2. Applicant has been arrested in connection with Crime No.511/2013 registered at Police Station- Saman, District Rewea (M.P.), for offences punishable under sections 147, 148, 327, 294, 323, 506-B, 34 and 302 of the IPC. 3. Earlier bail application was rejected on the ground that the applicant was absconding hence he was not entitled for bail. Thereafter, he has surrendered and presently, he is in jail since February, 2017. 4. The prosecution has examined four major witnesses including the eye witness Sajjan Singh (PW4). Sajjan Singh in his evidence has not recognised the applicant and does not named him as member of the gang who assaulted the deceased. He was the person who lodged the FIR and has been examined as PW1 AshoK Singh. He has also does not named the applicant in his deposition. 5. Considering these facts, I find it to be a fit case for grant of bail to applicant. 6. Accordingly, it is directed that applicant Neelesh Agnihotri High Court of Madhya Pradesh be released from custody subject to his furnishing personal bond in the sum of Rs.50,000/- (Rs. Fifty thousand only) with one surety in the like amount to the satisfaction of the trial Court for his appearance before the concerned Court on all the dates of hearing fixed in this behalf by the Court concerned during trial. 7. Miscellaneous criminal case stands allowed and closed.
