JUDGMENT Civil Appeal No. 4678 of 2017 was filed at the instance of petitioner who lost before the High Court. The petitioner sought appointment in a Non Joining Duty(NJD) vacancy that was turned down by the Public Service Commission and the stand of the Public Service Commission was confirmed by the State Administrative Tribunal and the High Court. 2. When the matter reached before this Court at the instance of the petitioner, this Court on 27th March, 2017 passed the following order:- "Leave granted. Heard learned counsel for the parties. In view of non joining the candidate of same category, in the peculiar facts and circumstances of the present case, we direct that the case of the appellant be considered afresh within a period of one month from today. The appeal is disposed of in above terms. Pending application(s), if any, shall also stand disposed of." 3. It appears that the Public Service Commission again considered the matter on merits and turned down the request of the petitioner and the hence the petitioner has invoked the contempt jurisdiction. 4. Learned counsel appearing for the Public Service Commission submits on written instruction that as a special case, this Court may invoke its jurisdiction under Article 142 of the Constitution of India and issue a positive direction for appointment, so that it will not be a precedent. 5. A reading of the judgment dated 27th March, 2017 would make it clear that it was a case where this Court had invoked Article 142 of the Constitution. Be that as it may, since now that the Commission has sought for a specific direction, we direct the Public Service Commission to issue an advice for appointment in the case of the petitioner within two weeks from today. On such advice being received, the appointing authority shall issue appointment orders without any further delay. 6. Subject to the above directions, the contempt petition is dismissed.
