JUDGMENT : Mr. Mahesh Chandra Sharma, J. 1. Instant civil misc. appeal has been filed against the impugned judgment and award under appeal. 2. Brief facts of the case are that the claimants filed claim petition before the learned Claims Tribunal claiming compensation. 3. Thereafter, notices were issued. Reply to the claim petition was filed before the learned Claims Tribunal. On the basis of the pleadings of the parties, the learned Claims Tribunal framed the issues. 4. The learned Tribunal after hearing passed the impugned judgment and award. The appellants aggrieved with the impugned judgment and award has preferred instant appeal before this Court. 5. Counsel for the appellants has submitted that the learned Tribunal has committed a grave error in not considering the facts of the case, material available on record and the grounds taken in the instant appeal. Thus, the impugned judgment and award passed by the learned Claims Tribunal be quashed and set aside. 6. On the other hand the learned counsel appearing for the respondents has opposed the aforesaid submissions and submitted that the learned Tribunal has rightly passed the impugned award and requires no interference of this Court. 7. I have heard learned counsel for the respective parties and carefully scanned the entire material made available to me. 8. From a perusal of the impugned judgment and award passed by the learned Tribunal it is clear that the learned tribunal has considered each and every aspect of the matter, thus requires no interference of this Court. However, I am in agreement with the observations made by the learned Claims Tribunal qua issue Nos. 8. From a perusal of the impugned judgment and award passed by the learned Tribunal it is clear that the learned tribunal has considered each and every aspect of the matter, thus requires no interference of this Court. However, I am in agreement with the observations made by the learned Claims Tribunal qua issue Nos. 1,2 and 4, which are reproduced as under: fook|d la[;k 1 o 2 mDr nksuksa fook|dksa dks izekf.kr djus dk Hkkj izkFkhZx.k ij gSA ;g nksuksa fook|d leku lk{; ij vk/kkfjr gS blfy;s budk fuLrkj.k ,d lkFk fd;k tk jgk gSA bu fook|dksa ds lEcU/k esa izkFkhZx.k dh vksj ls izLrqr lk{kh jktwyky ,0M0 1 us vius c;ku esa ;g dgk gS fd ikSus nks lky igys xyck cka/k vfu;kjk ls 6-30 cts og V~d esa ddMh] fV.Ms vkfn dh lCth ysdj jokuk gqvk FkkA mlds lkFk ?kklh] yM~Mw] lhrkjke vkSj mldk firk jkeyky Hkh FksA vYykiqjk xkao ds ikl V~d pkyd us V~d xQyr] ykijokgh o rsth ls pyk dj iyVk f[kyk fn;k] ftlls mlds firk jkeyky dh ekSr gks xbZA mlds vLirky Vksad esa irk pykA lkFk okys yM~Mw lhrkjke oxSjg us crk;k fd ;g nq?kZVuk V~d pkyd dh xyrh ls gqbZ FkhA ftjg esa bl xokg us ;g Lohdkj fd;k gS fd og nq?kZVuk ds le; ekSds ij ugha FkkA mlus bl rF; dks xyr crk;k gS fd mlds firk lCth ysdj ugha tk jgs gksa vkSj ;k=h ds :i esa ;k=k dj jgs gksaA mlus ;g Lohdkj fd;k gS fd mlds firk dh lHkh lUrkusa ckfyx gS vkSj viuk viuk dke djrs gSaA--------- eSaus mHk; i{k ds rdksZa ij fopkj fd;k rFkk mHk; i{k dh vksj ls izLrqr mDr U;k; n`"Vkarka esa izfrikfnr fl)karksa dk Hkh vknjiwoZd v/;u fd;kA mijksDr rdksZa ds ifjizs{; esa gesa ;g fofu'fpr djuk gS fd vk;k nq?kZVuk ds le; e`rd rFkkdfFkr V~d esa vkus lkeku ds lkFk Lokeh ds :i esa ;k=k dj jgk Fkk vFkok og ,d fu'kqYd ;k=h xszV;wfV;l iSlsUtj& Gratuitous passenger ds :i esa ;k=k dj jgk Fkk\-------- vr% mijksDr foospu] fo'ys"k.k ds vk/kkj ij ;g ck[kwch izekf.kr gS fd izfroknh la0 1 us rFkk dfFkr V~d dks izfri{kh la0 1 ds fu;kstu] fgrkFkZ ,oa ykHkkFkZ pyk dj V~d dks rsth xQyr o ykijokgh ls pyk;k ftlls V~d iyVk [kk x;k vkSj V~d esa lkeku ds lkFk cSBs e`rd jkeyky ds 'kjhj ij pksVsa vkus ds dkj.k mldh e`R;q gks xbZA vr% fook|d la0 1 o 2 izkFkhZx.k ds i{k esa rFkk izfri{khx.k ds fo:) fu.khZr fd;s tkrs gSaA fook|d la0 4 bl fook|d dks izekf.kr djus dk Hkkj izfri{kh la0 3 ij gSA chek dEiuh us vius tokc esa ;g dgk gS fd chek 'krksZa dk mYya?ku gksus ds dkj.k chek dEiuh {kfriwfrZ gsrq mRrjnk;h ugha gS] nq?kZVuk dh mUgsa lwpuk ugha nh xbZ gS jkeyky V~d eSa ;k=h ds :i eSa cSB dj tk jgk Fkk] mldk chek dEiuh us dksbZ izheh;e ugha fy;k gS] nq?kZVuk ds le; okgu pkyd ds ikl dksbZ oS| ykbZlsal ugha FkkA bl lEcU/k esa chek dEiuh dh vksj ls dksbZ lk{; izLrqr ugha dh xbZ vkSj ftl ,u0,0M0 2 fu'kkUr dks lk{; izLrqr fd;k x;k gS mlus vius c;ku eSa ;g dgk gS fd okgu dk chek 22 tuojh 2008 ls 21 tuojh 2009 rd chek ikWfylh izn'kZ 2 ds ek/;e ls fd;k x;k FkkA bl lk{kh ds bl dFku ls gh ;g izdV gksrk gS fd nq?kZVuk ds le; okgu chek dEiuh ds ikl chfer Fkk D;ksafd nq?kZVuk 25-04-2008 dh crkbZ xbZ gSA izkFkhZx.k dh vksj ls rFkkdfFkr okgu pkyd dk ykbZlsal izn'kZ 5 izLrqr fd;k x;k gS tks 20-05-2006 ls fnukad 19-05-2028 rd oSyhM gS vkSj bl izdkj nq?kZVuk ds le; izfri{kh la0 1ds ikl oS| ykbZlsal gksuk izekf.kr gSA ,slh fLFkfr esa ;g izdV ugha gksrk gS fd fdu 'krksZa dk mYya?ku gqvk vkSj fdl izdkj chek dEiuh {kfriwfrZ dh vnk;xh gsrq mRrjnk;h ugha gSA vr% chek dEiuh dh vksj ls bl fook|d ds leFkZu esa dksbZ lk{; izLrqr u fd;s tkus ds dkj.k ;g fook|d lk{; ds vHkko esa izfri{kh la0 3 chek dEiuh ds fo:) rFkk izkFkhZx.k ds i{k esa fu.khZr dh tkrh gSA 9.
