JUDGMENT : 1. Aggrieved of demand of Rs.2,15,867/vide letter dated 09.08.2010 for joining 1998Pension Scheme, the petitioner has approached this Court. 2. The respondents by filing an affidavit have pleaded that the petitioner superannuated from service on 19.12.1999, however, he did not fill up CMPS 1998 PS-1 Form at the relevant time. 2% deduction which was made from his salary towards the pension contribution was refunded to the petitioner on his application dated 03.08.2004. He was also paid admitted interest vide cheque dated 21.11.2005 which was received by the petitioner on 28.11.2005. The petitioner again opted for CMPS-1998 by filling up PS-1 Form on 28.07.2009 and he deposited Rs.50,239/- against 2% pension contribution. Through demand letter dated 09.08.2010, he has been directed to pay the balance amount of Rs.2,15,867/-. Evidently, the petitioner cannot raise a grievance to demand letter dated 09.08.2010. Now, it is an option to the petitioner either to opt for 1998-Pension Scheme or to seek refund of Rs.50,239/-. 3. In the above facts, no interference is warranted with demand letter dated 09.08.2010. The writ petition, bereft of merit, is dismissed.
