ORDER : ABHILASHA KUMARI, J. 1. Rule. Mr. Ronak Raval, learned Additional Public Prosecutor, waives service of notice of Rule for the respondents. 2. This application dated 29.06.2017, has been preferred by the applicant, through Jail, with a prayer to enlarge him on temporary bail for a period of thirty days on account of the stomach ailment, in the nature of stomach pain, suffered by his mother. It is also stated that the mother of the applicant has some “valve” problem. 3. The applicant is undergoing life imprisonment in connection with offences punishable under Sections 302 and 114 of the Indian Penal Code, 1860. 4. We have perused the averments made in the application as well as the Jail record pertaining to the applicant. 5. Though the conduct of the applicant in Jail is stated to be good, no medical record has been produced which may indicate the exact nature of disease from which his mother is suffering. 6. The OPD Slip dated 12.06.2017 from Shri Pandit Dindayal Upadhyay General Hospital, Rajkot, annexed to the application, does not reveal that any serious illness is being faced by the mother of the applicant, so as to require his immediate presence. 7. Though the Jail conduct of the applicant is stated to be good, however, the reason stated in the application does not convince us enough to grant the prayer made in the application. 8. Hence, the application stands rejected. Rule is discharged.
