ORDER : 1. Heard the learned counsel for the petitioners as well as the learned counsel for the respondents. 2. Petitioner has filed this writ petition to quash the impugned order dated 13.01.2016 passed by the Presidential Officer of Senior Citizens’ Maintenance Tribunal Cum Assistant Commissioner, Karwar vide Annexure – A. 3. It is submitted that the petitioners are the sons of respondent No.2. The petitioners along with their mother and respondent No.2 were living in Yadgiri, and completed their Engineering degree. It is submitted that the respondent No.2 herein filed an application under Section 5 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, seeking the relief of maintenance before the Court of the Assistant Commissioner, Karwar. 4. However, according to Section 16 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, any senior citizen or a parent, as the case may be, aggrieved by an order of a Tribunal may, within sixty days from the date of the order, prefer an appeal to the Appellate Tribunal. 5. Therefore, keeping in view the submission made by learned counsel for the petitioners as well as the respondents so also the provisions of Section 16 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, the writ petitions do not hold any substance to proceed further. Accordingly, the writ petitions are hereby disposed of. The petitioners herein shall approach the concerned Tribunal for redressal of their grievances in accordance with law. Learned AGA is permitted to file memo of appearance for respondent No.1 within a period of four weeks from today.
