ORDER : 1. Already appeal no.1056/2011 has been filed by the convict-Dasrath against the judgement dated 24.8.2011, whereby he has been convicted for offence punishable u/ss.376(2)(g) of IPC. Office has pointed out the defect in present appeal no.1200/2011, which has been filed subsequently that appeal no.1056/2011 has been filed previously. 2. Subsequent appeal no.1200/2011 by the same accused against the same judgement of his conviction, cannot be maintained. 3. The present appeal is therefore disposed of as not maintainable reserving right to the appellant to assail his conviction and sentence in the appeal no.1056/2011.
