ORDER : ABHILASHA KUMARI, J. 1. Rule. Mr. J.K Shah, learned Additional Public Prosecutor waives service of notice of Rule on behalf of respondent State. 2. This application, dated 19.06.2017, has been preferred by the applicant, through jail, with a prayer to grant him temporary bail for a period of 30 days in order to carry out the agricultural activities on his land during the monsoon season. 3. The applicant is undergoing life imprisonment for the offences punishable under Sections 302, 143, 147, 148 and 504 of the Indian Penal Code. 4. We have considered the averments made in the application as well as the jail record pertaining to the applicant which indicates that his conduct in jail is good. We have also noticed that on the previous occasions when the applicant was released on bail he has surrendered on time. 5. Mr. J.K Shah, learned Additional Public Prosecutor ha submitted for a perusal of the statement dated 12.07.2017 of the son of the convict as well as of the neighbour which indicates that applicant owns agricultural land. 6. In view of the reasons stated the application, we consider it appropriate to partly grant the prayer made in the application. Hence, we pass the following order: The applicant shall be released on temporary bail for a period of 10 days from the date of his actual release upon furnishing a personal bond of Rs. 5,000/- (Rupees Five Thousand only) and upon the usual terms and conditions, to the satisfaction of the concerned Jail authority. Upon expiry of the aforesaid period, the applicant shall surrender before the concerned Jail authority forthwith. 7. The application is allowed, in the above terms. Rule is made absolute to the above extent.
