JUDGMENT : A.B. Chaudhari, J. The petitioner has filed the present petition under Section 439 Cr.P.C. seeking regular bail in FIR No.33 dated 15.02.2017 registered under Sections 420, 465, 467, 468, 471 & 120-B IPC; Section 13 of Punjab Travel Professional Regulation Act, 2014 and Section 24 of Immigration Act at Police Station Navi Baradari, District Jalandhar. 2. Heard learned counsel for the rival parties. 3. The petitioner was arrested in this FIR on 15.02.2017 and since then he is in jail. 4. It is seen from the record that co-accused Pandian son of Applanaidoo having Malaysian passport indulged in cheating the people with promise to send them abroad after collecting money from them. Learned counsel for the petitioner has submitted that the co-accused Pandian has been granted regular bail by the trial Court. As per the prosecution allegation against the petitioner was that he was member of the group or gang which indulged in committing similar fraud and offence. However, it is seen that the money was actually received by Pandian who was granted bail by the trial Court. I am, therefore, inclined to grant bail to the petitioner. 5. It is seen that the agents who are not registered or licensed by the Government, have been taking money and sending the people abroad. That is at the cost of the people in the States of Punjab and Haryana and the gullible citizens have been falling in their trap. 6. In my opinion, one of the reasons appears to be the failure on the part of the States of Punjab and Haryana in not warning the people at large not to contact any unregistered or unlicensed person/agent and not to give any amount to them. The people who do not know about the fact that only licensed or registered agents could be approached, have been falling in the trap at the costs of losing their valuable properties, money and ornaments ultimately realizing that they have been cheated. The States of Punjab and Haryana are directed to issue immediate instructions to all the District Magistrates in each District to publish "the list of registered agents and to warn the citizens not to go to such unauthorized agents", on regular basis through Television, Radio, newspapers and any other mode of communication. 7. The statement made by Ms. Rajni Gupta, Additional Advocate General Punjab that the said arrangement has already been made by publishing the information on the website and print media, does not appeal to me to be sufficient as the offences are being reported day in and day out. 8. The compliance report shall be submitted by both the States of Punjab and Haryana on or before 05.07.2017 to this Court as to the action taken by the States. 9. In the result, I make the following order : ORDER (i) The CRL. MISC. No. M-16603 OF 2017 is allowed. (ii) The petitioner shall be released on bail to the satisfaction of the concerned CJM/Duty Magistrate. 10. Copy of this order be supplied to the learned counsel for both the States of Punjab and Haryana.
