SUMAN SHYAM

body2017
JUDGMENT : Heard Mr. S.C. Biswas, learned counsel for the petitioner. Also heard Mr. S.P. Choudhury, learned Govt. Advocate, Assam, appearing for the official respondents. 2. This writ petition was filed with the grievance against the State respondents on account of their refusal to register a police case on the basis of F.I.R. dated 19.05.2014 lodged by the petitioner against the respondent Nos.7 and 8 before the Officer-in-Charge, South Salmara Police Station. Mr. Biswas submits that a police case has since been registered. However, the investigation has not progressed in the desired manner as a result of which the petitioner continues to feel aggrieved in the matter. 3. Since the writ petition was filed basically with the prayer for registration of a police case and the same has already been done, I do not find any justifiable ground to keep the writ petition pending any further. As such, this writ petition is hereby closed. The petitioner is however, granted liberty to avail remedy under the Cr.P.C. by moving the appropriate authority seeking expeditious investigation in the matter. If the petitioner continues to feel aggrieved in the matter despite such steps having been taken, he will be at liberty to approach this Court by filing a writ petition afresh. 4. With the above observation, this writ petition stands disposed of.
