ORAL ORDER : ABHILASHA KUMARI, J. Rule. Mr. J.K. Shah, learned Additional Public Prosecutor waives service of notice of Rule on behalf of respondent State. 2. This application, dated 10.07.2017, has been preferred by the applicant, through jail, with a prayer to extend the period of on temporary bail granted to him vide order dated 10.07.2017 passed in Criminal Miscellaneous Application No. 17015 of 2017, whereby he was directed to be released on temporary bail for a period of ten days on the ground of enabling him to perform agricultural activities. 3. The applicant is serving sentence of life imprisonment in connection with the offence punishable under Section 302 of the Indian Penal Code. 4. In the present application, the applicant has stated that due to heavy rains there is flood like situation in Banaskantha district and the applicant and his family are therefore in a critical condition. He, therefore prays for the extension of temporary bail on this ground. 5. Taking into consideration the reasons stated in the application and the aspect that his conduct in jail is good, we deem it appropriate to partly grant the prayer made in the application. Hence, the following order. 6. The period of temporary bail granted to the applicant vide order dated 10.07.2017 passed by this Court in Criminal Miscellaneous Application No. 17015 of 2017 is hereby extended by a further period of ten days upon the usual terms and conditions, to the satisfaction of the concerned Jail authority. 7. Upon expiry of the aforesaid period, the applicant shall surrender before the concerned Jail authority forthwith. 8. It is made clear that no further extension shall be granted. 9. The application is allowed, in the above terms. Rule is made absolute to the above extent.
