ORDER: Rathnakala, J. Heard the learned counsel appearing for the petitioner/accused and the learned High Court Government Pleader appearing for the respondent-State. 2. The petitioner is charge-sheeted by the respondent-police in their Cri. No. 34/2017 in respect of the offences under sections 376, 420, 506 of IPC and 3(1)(r), 3(1)(s), 3(2)(v-a), 3(1)(w), 3(i)(ii) of SC/ST Act, 1989. 3. The case of the prosecution is, the prosecutrix is a Member of the scheduled caste. The petitioner and the prosecutrix came in contact with each other and developed intimate relationship. He took her to an isolated place and committed rape on her. Some time later, he made her to consume contraceptive pills and thereafter abandoned her. He abused her filthily by referring to her caste. He used to put threat to her life by using different mobile phones etc. 4. Learned counsel for the petitioner submits, accepting the charge-sheet materials as it is, no case under Section 376 of IPC is made out. The telephone numbers alleged by the Investigating Officer as that of the petitioner do not belong to him. The petitioner is not a person with criminal antecedents. He undertakes to abide by any condition that may be imposed on him. 5. Learned Government Pleader opposes the petition. 6. Perused the charge-sheet papers. Having regard to the nature of the allegation, since the petitioner is not shown to have criminal records, there is no impediment to allow the petition. The petition is allowed. Petitioner is enlarged on bail in Crime No. 34/2017 of respondent-police, subject to the following conditions: (i) He shall execute a self bond for a sum of Rs. 1,00,000/- with one surety for the like sum to the satisfaction of the concerned Court. (ii) He shall attend the Court regularly on all hearing dates. (iii) He shall not threaten or terrorize the complainant and her family members.
