ORAL ORDER : ABHILASHA KUMARI, J. Rule. Mr. J.K. Shah, learned Additional Public Prosecutor, waives service of notice of Rule for the respondents. 2. This application dated 18.07.2017, has been preferred by the applicant-convict, with a prayer to fix an early date of final hearing for the Criminal Appeal filed by him being Criminal Appeal No. 869 of 2013, which has been admitted and is pending before this Court. 3. The applicant has stated that he has already served five years and four months of sentence. 4. We have perused the averments made in the application as well as the Jail remarks pertaining to the applicant, which indicate that his conduct in Jail is good. 5. Though the applicant has stated that he has served five years and four months of sentence in Jail, however, it appears from the Jail remarks that he has actually served four years and ten months' sentence of life imprisonment for offences punishable under Sections 302 and 201 of the Indian Penal Code, 1860. 6. Taking into consideration the averments made in the application and as the appeal filed by the applicant pertains to the year 2013, we deem it appropriate to pass the following order: Criminal Appeal No. 869 of 2013 be fixed for final hearing on 06.09.2017 7. The application is allowed. Rule is made absolute, accordingly.
