JUDGMENT : Dinesh Mehta, J. Mr. Kailash Jangid, learned counsel for the petitioner s submits that identical matter has been disposed of by the Jaipur Bench of this Court vide its judgment dated 29.11.2016, passed in S.B. Civil Writ Petition No.14499/2016 Ram Avatar Singh & Ors. v. State (Education Department) Ors. 2. Learned counsel for the petitioners submits that the petitioners had applied in pursuance of advertisement dated 01.05.2011, as amended on 24.2.2012, for the post of Teacher Gr.II. Learned counsel submits that due to pendency of writ petitions before this court pertaining to wrong answer key, appointment of the petitioners was delayed. However, persons junior to the petitioners were earlier appointed. Learned counsel submits that respondents are now revising the seniority list and respondents be directed to adhere to the merit as per select list for preparation of seniority list dehors of the date of joining as there was no fault on the part of the petitioners and delay, if any, was on the part of the respondents. 3. Learned counsel for the respondents submits that the respondents are in the process of finalizing the seniority list and the petitioners may approach the respondents by making necessary representation. 4. After hearing learned counsel for the parties, present petition is disposed of by issuing following directions:- (a) That the petitioners shall submit representation before the respondents which shall be duly considered by the respondents by passing a speaking order before circulating the provisional seniority list. (b) That the respondents before finalization of seniority list, shall circulate a provisional seniority list inviting objections from all concerned. (c) That in case the petitioners are still aggrieved by the provisional seniority list, they may file objections upon circulation of the provisional seniority list. (d) That the objections to be filed by the petitioners shall be decided by the respondents by passing a speaking order. 5. In view of above directions, present petition stands disposed of. 6. Upon disposal of main petition, the stay application, filed therewith does not survive and the same is also disposed of.
