Medical Council of India v. Principal Mount Zion Medical College

2017-09-06

A.M.KHANWILKAR, AMITAVA ROY, DIPAK MISRA

body2017
ORDER : 1. Leave granted. 2. Heard Mr. Vikas Singh, learned senior counsel along with Mr. Gaurav Sharma, learned counsel for the appellant and Mr. Kapil Sibal, learned senior counsel for the respondent. 3. Having heard learned counsel for the parties, we are of the considered opinion that the High Court should not have entertained the writ petition and pass any interim order. Therefore, we allow these appeals and set aside the impugned orders. As we have granted liberty in other cases for preferring petition under Article 32 of the Constitution of India, the same liberty is also granted to the respondent-institutions here also. 4. As the said writ petitions have already been filed, they may be listed on Friday, 8th September, 2017 along with and other similar matters. 5. No order as to costs.
