ORDER : Harsha Devani, J. By this application, the applicant-convict through his wife, seeks to be enlarged on temporary bail for a period of 30 (thirty) days for the purpose of obsequial ceremonies in connection with the death of his brother in law (sister's husband) Arunbhai Shivanbhai Indrekar, who has passed away on 07.08.2017 2. Heard applicant's wife, who appeared in person. 3. Mr. R.C Kodekar, learned Additional Public Prosecutor has placed on record a report dated 08.08.2017 of the Police Inspector, Naroda Police Station, which indicates that cause stated in the application is genuine. 4. Under the circumstances, the court is inclined to exercise discretion in favour of the applicant. The application, therefore, partly succeeds and is, accordingly, allowed to the following extent : 5. The applicant-convict is ordered to be enlarged on temporary bail for a period of two days from 10.08.2017 to 11.08.2017 upon his executing a bond in the sum of Rs. 5,000/- (rupees five thousand) to the satisfaction of the jail authorities on the usual terms and conditions. Upon completion of the period of temporary bail, the applicant shall forthwith report to the jail authorities. Rule is made absolute accordingly. 6. Registry to forthwith communicate this order to the jail authority, TODAY.
