JUDGMENT : Ramendra Jain, J. This petition has been filed by petitioner-Vipan Kumar @ Jatinder Khurana, under Section 439 Cr.P.C., 1973 for grant of regular bail in case FIR No. 47 dated 07.04.2016 registered under Sections 302, 506, 148, 149 IPC and section 25 of the Arms Act (Section 323 IPC and section 27 of the Arms Act added later on) at Police Station Dugri, District Ludhiana. 2. Learned counsel for the petitioner contends that though the petitioner was named in the FIR, but no role has been attributed to him. His co-accused, namely Mandeep Kumar Sharma, has already been granted bail by this Court vide order dated 17.05.2017 passed in CRM-M-14612-2017. The role attributed to the petitioner is akin to that of his co-accused Mandeep Kumar Sharma and thus, treating the case of the petitioner on the same parity, he be released on bail. 3. On the other hand, learned State counsel vehemently opposed the submissions made by learned counsel for the petitioner. 4. I have given my anxious consideration to the submissions made by learned counsel for the parties. 5. Considering the overall facts and circumstances of the case and the fact that co-accused of the petitioner, namely, Mandeep Kumar Sharma, whose role is akin to the petitioner has already been granted the concession of regular bail by this Court, the petitioner is at least deserves the concession of regular bail. 6. Thus, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail; without expressing any opinion on the merits of the case and also that the trial is likely to take time, the instant petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bonds in the sum of Rs. 50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
